Terms of Use & Licence
These Terms of Use ("Terms") govern your use of InspectPro Solo ("the app"), a property inspection reporting application operated by Selah AI Consulting Ltd ("InspectPro", "we", "us", "our"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
These Terms are governed by New Zealand law. Nothing in these Terms limits or excludes any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Privacy Act 2020, or any other New Zealand legislation that cannot lawfully be excluded. For users in Australia, nothing in these Terms limits any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
1. About the app. InspectPro Solo is a professional tool for property inspectors. It lets you create and manage inspection reports, document findings with photos and notes, and generate and share PDF reports. The app is local-first: everything you create stays on your device.
2. Who these Terms apply to. The app is sold as a single-user subscription for solo inspectors. Where these Terms distinguish consumer from business use: consumers are individuals acquiring the app for personal or small-business use; business users acquire it wholly or predominantly for business purposes and may contract out of certain statutory guarantees where the law permits.
3. Subscription. The app is offered as an auto-renewing subscription of US$39 per month, with a store-managed introductory free trial. All billing is handled by the Apple App Store or Google Play; we do not see, process, or store any payment information. Full billing, trial, renewal, and cancellation terms are in our Billing Policy.
4. No account. The app does not use accounts. There is no registration, no login, and no password. Your subscription is tied to your App Store or Google Play account, managed entirely by the store.
5. Your content and data. You retain all ownership of the inspection data, photos, notes, and reports you create. We claim no ownership of your content. You are responsible for ensuring your content is accurate, lawful, and does not infringe the rights of others; where it includes personal information about third parties (for example property owners or clients), you are responsible for having the authority or consent to record and use it.
6. Local-first storage and backups. All inspection data is stored locally on your device. This is the only copy. The app makes no network connections of its own and does not sync your data to any server. You can create a full backup at any time via Settings, Data Management (a ZIP export you save wherever you choose); restoring a backup replaces the data on your device. We also recommend your device's own backup features. You are responsible for maintaining your own backups; no backup system is infallible, and we cannot recover data lost from your device.
7. Acceptable use. You agree to use the app only for lawful purposes. You must not create false or misleading reports, use the app in connection with unlawful activity, infringe anyone's rights, attempt to reverse engineer or extract the app's source code, or resell or sublicense the app without our written consent.
8. Professional responsibility. The app is a tool to assist with inspections; it does not replace professional judgment, expertise, or qualifications. You are responsible for the accuracy and completeness of every report you create, for applying your professional skills, and for complying with any professional standards or legal requirements applicable to your work (including, where relevant, the Building Act 2004). We do not guarantee that reports created with the app will meet any particular professional standard or regulatory requirement.
9. Service standards and consumer guarantees. We will provide the app with reasonable care and skill. Nothing in these Terms limits the guarantees you have under the Consumer Guarantees Act 1993 if you are a consumer. If you acquire the app in trade and the CGA does not apply, we exclude, to the maximum extent permitted by law, all implied warranties not expressly stated here.
10. Limitation of liability. Nothing in this section limits our liability to consumers under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you are a business user and the CGA does not apply, our total liability for all claims arising under or in connection with these Terms or your use of the app will not exceed the greater of the subscription fees you paid in the 12 months before the claim, or NZD 500 dollars; and we exclude all liability for indirect, incidental, special, or consequential loss, loss of profits, and loss or corruption of data (except where caused by our wilful misconduct). Nothing excludes liability for death or personal injury caused by negligence, or for fraud.
11. Intellectual property and licence. InspectPro Solo, its design, software, and trademarks are owned by or licensed to Selah AI Consulting Ltd. We grant you a limited, personal, non-transferable, revocable licence to use the app on devices you own or control, for the duration of your active subscription. You may not copy, modify, reverse engineer, sublicense, or redistribute the app except as the law permits. This licence and the End User Licence Agreement govern your use of the software.
12. Privacy. The app collects no personal data and transmits nothing off your device. Our Privacy Policy explains this in full and forms part of these Terms.
13. Changes to these Terms. We may update these Terms from time to time. We will post the updated Terms in the app and, where required, ask you to re-accept them. Continued use after the changes take effect constitutes acceptance.
14. Termination. You may stop using the app at any time by uninstalling it and cancelling your subscription through your device's store settings. Your locally stored data remains on your device and is not deleted by us. Your licence ends if your subscription lapses or you materially breach these Terms.
15. Dispute resolution. If you have a concern, contact us first at support@aiconsult.co.nz and we will work in good faith to resolve it. If we cannot resolve it, either party may bring the matter to the New Zealand Disputes Tribunal (for claims within its jurisdiction) or a New Zealand court. Nothing in this clause limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
16. Governing law. These Terms are governed by the laws of New Zealand, and the parties submit to the exclusive jurisdiction of the New Zealand courts.
17. General. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains in force. A delay in enforcing a right is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours to a successor entity. These Terms, together with our Privacy Policy, Billing Policy, and EULA, are the entire agreement between you and us about the app. If you download the app from the Apple App Store, Apple's terms also apply and prevail to the extent Apple's guidelines require.
